Burning Regulations
Code of Ordinances Ch. 93, Sec. 93.03

Section 93.03 - Burning Regulations.

(A) No person shall kindle or maintain any bonfire or rubbish fire or permit any such fire to be kindled or maintained within the city limits except as otherwise provided in this chapter. The Director of Public Safety may permit the demolition of buildings or materials by fire if it appears to be in the best interest of the community or as a training exercise for the Fire Department.

(B) Fire of LP or Natural gas, charcoal, or wood chips for the purpose of outdoor cooking are permitted provided that such fires are contained in a metal, brick or other fireproof container designated for cooking. Other types of wood not exceeding 24 inches in length for the purpose of outdoor cooking shall be permitted upon obtaining written approval from the Fire Marshal.

Section 93.99 - Penalty.

Any person who shall violate any of the provisions of the Uniform Fire Code or any order made pursuant to the Uniform Fire Code, or who shall build in violation of any detailed statement of specifications or plans submitted and approved, or any certificate or permit issued, and from which no appeal has been taken or who shall fail to comply with such an order as affirmed, or modified by the Director of Public Safety or by a court of competent jurisdiction, within the time fixed herein, shall severally, for each and every such violation of noncompliance, respectively, be guilty of a misdemeanor punishable by a fine not to exceed $500 and/or not exceeding 90 days in jail. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. Any violation of the Uniform Fire Code by any employee shall be deemed the act of the employer as well as the person actually violating the Code, and such employer shall be subjected to a fine not to exceed $500 plus court costs and/or imprisonment not to exceed 90 days for each violation.
